Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Arcon mobile applications, web checkout, and related services (together, the "Service") that let you find electric vehicle ("EV") charging stations, start and stop charging sessions, and pay for them. The Service is operated by Arcon Inc. ("Arcon", "Arcon Mobility", "we", "us", or "our"), a company organized under the laws of the Republic of the Philippines with its principal office at Lady of Fatima Building, 1849 Pililia St., Santiago Village, Valenzuela, City of Makati, Fourth District, National Capital Region, 1208, Philippines.

By creating an account or using the Service, you agree to these Terms. Please also read our Privacy Policy and our Refund & Cancellation Policy, which are part of these Terms.

  • By tapping "I agree", creating an account, or using the Service, you confirm that you have read, understood, and accept these Terms.
  • You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract.
  • You must use the Service in compliance with all applicable Philippine laws and the laws of any place where you use it.
  • If you use the Service on behalf of another person or an organization, you confirm you are authorized to bind them to these Terms.

Arcon uses passwordless sign-in. You can access your account by:

  • Email one-time code: we send a single-use code to your email address, which you enter to sign in.
  • Sign in with Google: using your Google account.
  • Sign in with Apple: using your Apple ID.

You are responsible for:

  • Providing accurate account information (such as email, phone number, and name) and keeping it up to date.
  • Maintaining control of the email account, Google account, or Apple ID you use to sign in.
  • All activity that occurs under your account.

Please notify us immediately at support.arcon.mobi if you believe your account has been accessed without your authorization. We may refuse, suspend, or cancel an account at our discretion, subject to Section 11.

Arcon is a platform and intermediary that connects EV drivers with independent Charge Point Operators ("Operators"). Through the Service you can:

  • Discover nearby charging stations and view their details, availability, and pricing.
  • Start and stop charging sessions at participating stations.
  • Pay for charging sessions and receive receipts.

Important things to understand about how Arcon works:

  • Operators provide the stations and electricity. The physical charging stations, charging equipment, and electricity are owned, operated, and maintained by independent Operators, not by Arcon.
  • Operators set the tariffs. The price of a charging session (the "tariff") is set by the Operator for each station, not by Arcon. Arcon displays this pricing to you before you begin.
  • Arcon facilitates discovery, session control, and payment. We provide the software that helps you find stations, start and stop sessions, and pay. We are not the seller of the electricity.
  • Operators use an AI assistant to run their stations. Operators have an AI assistant, Ampere, inside their own dashboard. It can suggest actions on their stations, including stopping a charging session remotely, which the Operator must confirm before anything happens; the assistant never acts on its own. It is not part of this app and you do not interact with it. The session records it can see describe the station, timing, energy, cost, and status of a session, and do not include your name, email address, phone number, or account identifier. Because stations are operated by third parties, Arcon does not guarantee that any station will be available, functional, compatible with your vehicle, or free from faults at any given time.

When using the Service, you agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Tamper with, damage, or misuse any charging station, connector, or equipment.
  • Attempt to charge a vehicle or device that a station is not designed or rated for.
  • Interfere with, disrupt, reverse engineer, or attempt to gain unauthorized access to the Service or its systems.
  • Use another person's payment method or account without authorization.
  • Resell, sublicense, or commercially exploit the Service without our written consent.
  • Introduce malware or use bots, scrapers, or automated means to access the Service outside of documented interfaces.

We may investigate and take action, including suspension or termination, for any suspected violation.

  • Before starting a session, the app shows the applicable tariff set by the Operator (for example, a price per kilowatt-hour of energy, a price per minute of time, and/or applicable fees).
  • Charges are calculated based on the energy delivered and/or time used during your session, according to the Operator's tariff and the data reported by the charging station.
  • You are responsible for correctly connecting your vehicle, monitoring your session, and ending it in accordance with station and vehicle instructions.
  • Session data (such as start/stop times, energy delivered, and cost) is recorded by the station and made available to you through the Service.
  • Prices are shown in Philippine Pesos (PHP) and, where applicable, are inclusive of taxes required to be charged by the Operator.

  • Payments are processed through PayMongo, a licensed Philippine payment service provider. By paying through the Service, you also agree to any applicable terms of the payment provider.
  • All amounts are charged in Philippine Pesos (PHP).
  • Operators are the sellers/merchants of record for the electricity and charging services. Arcon charges a platform commission and facilitates payment collection and settlement on the Operators' behalf.
  • A pre-authorization hold may be placed on your payment method at the start of a session to cover the estimated cost, with the final amount captured when the session ends. See the Refund & Cancellation Policy for details.
  • BIR receipts. Official receipts for charging services are issued in accordance with Philippine Bureau of Internal Revenue (BIR) requirements. Because the Operator is the seller, the applicable receipt reflects the Operator as the merchant.
  • Refunds and cancellations are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference.

EV charging involves electricity and high-power equipment. By using the Service, you acknowledge and agree that:

  • You will read and follow all safety instructions, warnings, and operating procedures provided by the charging station and by your vehicle manufacturer.
  • You are responsible for confirming that a station and connector are compatible with, and safe for, your vehicle before charging.
  • You will not use equipment that appears damaged, and you will stop use and report any fault, spark, overheating, smoke, or hazard immediately.
  • Arcon does not manufacture, install, own, or maintain the charging stations and is not responsible for their physical condition, electrical safety, or compliance, which are the responsibility of the Operator.

You use charging stations at your own risk, and you assume the risks inherent in EV charging to the extent permitted by law.

  • The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, except as required by applicable law (including the Consumer Act of the Philippines, RA 7394).
  • We do not warrant that the Service will be uninterrupted, error-free, secure, or that stations will be available, accurate as to pricing or availability, or fit for a particular purpose.
  • Nothing in these Terms excludes or limits any rights you have that cannot be excluded or limited under Philippine law.

To the maximum extent permitted by applicable law:

  • Arcon is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or vehicle downtime, arising out of or relating to the Service.
  • Arcon is not responsible for the acts or omissions of Operators, including the condition, safety, availability, pricing, or performance of any charging station.
  • These limitations do not apply to liability that cannot be limited under Philippine law, including for death or personal injury caused by our negligence, or for our fraud.

To the extent permitted by law, you agree to indemnify and hold harmless Arcon and its officers, employees, and agents from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

  • You may stop using the Service and close your account at any time by contacting us at support@arcon.mobi
  • We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to do so by law, or if we reasonably believe your use poses a risk to the Service, other users, Operators, or the public.
  • Amounts owed for completed sessions remain payable, and any pending refunds remain governed by the Refund & Cancellation Policy.
  • Sections that by their nature should survive termination (including Sections 8, 9, 10, and 13) will survive.

We may update these Terms from time to time. When we do:

  • The current version and its effective date are always shown at the top of this document.
  • Material changes will be notified to you by email and will require your re-acceptance before you continue using the Service.
  • Prior versions remain available at their dated URLs for your reference.

Your continued use of the Service after changes take effect means you accept the updated Terms.

  • These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws principles.
  • The Electronic Commerce Act (RA 8792) applies to electronic documents, signatures, and acceptance under these Terms.
  • We encourage you to contact us first so we can try to resolve any concern informally.
  • Any dispute that cannot be resolved informally will be subject to binding arbitration in Makati City, administered by the Philippine Dispute Resolution Center, Inc. (PDRCI) in accordance with its rules.
  • Nothing here limits your rights to bring a complaint before the appropriate Philippine consumer protection or regulatory authority.
